K-1 Fiancé

The K-1 nonimmigrant visa allows the Fiancé of a U.S. citizen to enter the United States for a 90-day period to marry and apply for conditional permanent resident status (green card).

  1. Applicants who have a communicable disease, or have a dangerous physical or mental disorder; are drug addicts; have committed serious criminal acts, including crimes involving moral turpitude, drug trafficking, and prostitution; are likely to become a public charge; have used fraud or other illegal means to enter the United States; or are ineligible for citizenship, must be refused a visa.
  2. Have previously met in person within two years of filing the petition.
  3. The parties must demonstrate the existence of a bona fide fiancé relationship and the intention to marry within 90 days of the foreign national's admission as a K-1.
  4. The parties must be legally able to marry. If the parties were previously married, they must be able to prove that any previous marriage was terminated through death or divorce.
  1. Valid passport, Birth certificate;
  2. Divorce or death certificate of any previous spouse;
  3. Police certificate from all places lived since age 16;
  4. Medical examination;
  5. Evidence of support;
  6. Evidence of valid relationship with the petitioner such as photographs, letters, bank statements, tax returns, joint title on assets, airline tickets etc.

  1. Gather Documents;
  2. Attorney evaluation;
  3. Sign representative Agreement;
  4. Submit I-129F;
  5. USCIS Approval and transfer documents to State Dept.;
  6. When the embassy receives the file from the State Department, they send a Packet 3 to the beneficiary.
  7. Attorney help to prepare Packet 3.
  8. Returning the form in Packet 3 (DS-156 and DS-156K) certifying that all required documents have been obtained.
  9. The Embassy will send out Packet 4 and scheduling an appointment for a visa interview;
  10. Fiancé should come to the Immigrant Visa section of the Embassy for a visa interview.
